WorkChoice Payday Shocker

Guarantee of Weekly or Fortnightly Pay Day Under Threat From IR Laws

Many Australian workers could lose their right to be paid on a weekly or fortnightly basis under the Federal Government's new industrial relations laws the ACTU said today.

ACTU Secretary Greg Combet said today:

"Hidden in the detail of the Government's new WorkChoices industrial relations legislation are new rules that remove the right of workers under industrial awards to be paid on a weekly, fortnightly or even monthly basis.

Under the Government's new IR laws all provisions in awards relating to how and when employees are required to be paid will become 'non allowable'.

This means that it will no longer be possible to include the following types of clauses in employment awards:

  • The requirement that employees be paid on a weekly or fortnightly basis;

  • Provisions that employees paid by cheque are given time to cash the cheque;

  • Provisions that enable employees to nominate which bank account they are paid into;

  • Provisions that on termination wages must be paid within a reasonable time.

These changes will effectively abolish the right under industrial awards of Australian workers to be paid on a weekly or fortnightly basis.

The guarantee for every employee under the award safety net to be paid regularly and on time is to be taken away.

Employers will have the right to unilaterally determine when and how regularly their employees are to be paid and workers will have no come-back if their employer fails to pay them on time other than to go to court.

Under John Howard's IR system it would be legal for an employer to pay their staff only once every 3 months or even only once a year.

In some States there is protection under the State laws but the Federal Government says that it wants to override State laws to establish its national system.

At least two million employees covered by awards will be immediately affected by the changes and over time, potentially all Australian workers may be affected.

This is just another example of how these IR laws will strip away even the most basic workplace rights of Australian employees" said Mr Combet.
